The preceding terms and conditions represent your and individual Mr. Yevgeniy Drozdov’s (Identification Code 304731716) (hereinafter referred to as “Company” “Ignite.Salon”) agreement regarding the use of the website https://ignite.salon/.

The Company will use information obtained from you or third parties and will process it in accordance with the specified confidentiality policy.

1.1.7. Parties – refers to the company and its users;

1.1.8. Order – Registration of a user’s product addition to the cart on the webpage and confirmation of the order with the entry of relevant information and payment confirmation;

1.1.9. Universal Identifiers – refers to the uniformity of user data on https://ignite.salon, which is registered in the identification system and enables the use of online store opportunities;

1.1.10. Product – Men’s grooming products and their additional services available on https://ignite.salon.

1.1.11. Agreement – The preceding document on the terms and conditions of use of the website.

2. Announcements and Guarantees:

2.1. By agreeing to the terms and conditions, the user confirms that:

2.1.1. They are legal entity or a natural person established in accordance with the legislation of Georgia, at least 18 years of age, and not deprived of civil rights;

2.1.2. They have full (unrestricted) legal capacity, do not abuse narcotic, alcoholic, psychotropic, or toxic substances, do not have a criminal record, and not under investigation are not subject an object of prohibition such as bankruptcy, insolvency, addition, or any other prohibited conduct.

2.5. The user’s entire activity or action in relation to the opening of a personal account and the execution of the Agreement, after its opening, corresponds/complies with local and international legislation;

2.6. It is mandatory for the user to provide ignite.salon with personal information connected to them or any personal information connected to them before the termination of the Agreement;

2.7. ignite.salon has the right to send the user SMS and e-mail notifications regarding the registration and order receiving process on the site.

3. Opening User Account – Usage, Order Fulfillment:

3.1. User Obligations in Relation to ignite.salon Services:

3.1.1. To use the services of ignite.salon for subscribing to products and placing orders from the online store, the user must:

• Pass registration/authorization on the website using their email;

• For order fulfillment, the user must specify the delivery method: either pickup from the address or delivery to a specified location. Information regarding delivery terms and costs will be provided on the website, based on the user’s location;
• After selecting the delivery or pickup method, the user proceeds to the corresponding bank’s website, where they enter their banking details and make the payment for the order.

4. Universal Identifiers registered in the identification System:

4.1. User Name – A uniquely defined parameter specified by the user for remote service authorization purposes.

4.2. Password – A centrally defined parameter required for remote service authorization within the centralized remote service operations, which the user defines themselves.

4.3. Mobile Phone Number – The phone number through which the user receives centrally defined access codes and passwords (in cases where such exists) for performing specified operations or necessary information for service reception.

4.4. User’s Email Address – The email address through which the user receives centrally defined access codes and passwords (in cases where such exists) for performing specified operations or necessary information for service reception.

4.5. For the purpose of service enhancement and security, the company may specify additional or modified user identifiers.

5. Product, Order Delivery and Terms

5.1. The production listed on the website includes various options for men’s grooming and other services, which are not produced by ignite.salon. Therefore, the salon relies on information provided by the manufacturer and cannot guarantee the accuracy and completeness of the information.

5.2. Following order confirmation, a representative of the company contacts the user to provide full information regarding product delivery or collection.

5.3. The user has the right to collect their order from the company’s physical address on the same day as the order, at the following location: Tbilisi, Vazha-Pshavela 85, Barber Shop Ignite, during working hours from 10:00 to 21:00.

5.4. If the user opts for delivery to a location, the company arranges delivery using its courier service or contractor, typically within 2 business days for Tbilisi and within 5 business days for regions.

5.5. Upon order confirmation, the manufacturer is responsible for the production, while ignite.salon is responsible for delivery. Therefore:

• There should be no damage to the contents of the order (including packaging) during transportation;
• Delivery must be safe;
• Delivery should be conducted in a manner that prevents damage to the contents during transportation and does not pose a risk to individuals who handle the delivery after it has been completed;
• If the user notices that the product is damaged or incomplete upon delivery to the specified location, they should immediately contact the company using the provided contract details and send photos of the received product and so on. In such cases, the user is required to contract the company immediately using the provided contract details and send photos of the received product. 6. Liability and limitation of Liability of ignite.salon

6.3. You confirm that the company will not be liable to you or any other party for any changes, access restrictions, or service interruptions on the website.

6.4. ignite.salon accepts material responsibility for the damage caused by its negligence in the following cases of your order:

6.4.1. Loss;

6.4.2. External Damage;

6.4.3. In case of untimely delivery of the order;

6.5. ignite.salon’s liability is valid in the following cases:

6.5.1. The order was lost;

6.5.2. In the case of external damage to the order, if such damage is detected before its transfer to the customer, or immediately during its transfer;

6.6. ignite.salon’s liability is excluded:

6.6.1. If the order has been delivered to the user and he has not immediately reported the loss and/or damage;

6.6.2. In relation to the order, the reason for which it was not delivered to the customer was the incorrect (incomplete) information specified by him/her;

6.6.3. In the event of circumstances caused by force majeure.

7. Force Majeure

7.1. The parties shall be release from liability for failure to fulfill their obligations if such failure is caused by the occurrence of force majeure or similar circumstances beyond their control, which exceed the capabilities of the Parties.

7.2. Actions such as strikes, lockouts, riots, sabotage or other acts of local authorities, war, military actions, blockade, embargoes, earthquake, flooding, epidemic, and other similar events not subject to control of the Parties and preventing them from fulfilling their contractual obligations shall be considered as force majeure.

7.3. The occurrence or non-occurrence of force majeure circumstances shall not lead to the imposition of sanctions for non-performance of contractual obligations.

7.4. If the force majeure event lasts longer than the period specified for the fulfillment of obligations in this document, the deadlines for fulfilling the obligations stipulated herein shall be extended by the period during which the force majeure event prevented the fulfillment of obligations.

7.5. The parties are obliged to notify the other party immediately about the impossibility of fulfilling the obligation as a result of force majeure. If immediate notice is not possible, at the earliest opportunity, but no later than 7 days after the occurrence of such circumstances. In case of non-delivery of the notification within the mentioned period, the violating party has no right, in order to be released from responsibility, to indicate such circumstances, if the non-delivery of the notification was not caused by these circumstances;

7.6. If the duration of the force majeure circumstance lasted longer than 30 (thirty) days or immediately after its occurrence it became clear that the action will last longer than 30 (thirty) days, the parties resolve the issue of the appropriateness of the contract. In case of disagreement between the parties, the decision on termination is made by the party to whom the obligation is not fully fulfilled. During such termination of the contract, the parties shall, as far as possible, within a reasonable time, correct all pre-existing obligations towards each other.

8. Validity period and termination of the agreement

8.1. After the entry into force of these Terms and Conditions, they remain in effect until the user’s registration is cancelled;

8.2. The user has the right to cancel registration and delete his/her account at any time;

9. Regulatory legislation and dispute resolution procedure

9.1. The present terms and conditions are regulated and interpreted in accordance with the legislation of Georgia;

9.2. The place of fulfillment of the conditions by the parties is Georgia;

9.3. Any disputes or disagreements relating to these Terms or their interpretation shall be resolved by negotiation between the parties;

9.4. If the parties fail to reach an agreement through negotiation within 30 (thirty) calendar days, they unconditionally agree to resort to other means of dispute resolution granted to them by the legislation of Georgia.

10. Making changes to these conditions:

10.1. These terms and conditions may be subject to change. ignite.salon will implement changes without prior notice to the user, however, in case of substantial changes in the conditions, the user must again express his consent to continue receiving the service without interruption. At each material change to the terms, the user will have the opportunity to express his consent when using ignite.salon through any channel.

11. Transitional Provisions:

11.1. The headings mentioned in these Terms are used for convenience only and shall not affect the interpretation or interpretation of the Terms.

11.2. If any clause or part of these terms and conditions is revoked, invalidated or terminated for any reason, the said clause or part thereof will no longer apply, which will not affect the validity of the remaining clauses of the terms.
